▶飲み会でセクハラ発言を止めず懲戒処分 「制止義務なく無効」と判決

The company failed to prevent sexually harassing comments during a social gathering, and the employee who made them was disciplined. However, a court ruled that the disciplinary action was invalid because the company had no obligation to prevent such behavior.

▶社員同士の飲み会で同席者のセクハラ発言を止めなかったことを理由に懲戒処分とされたのは不当だとして、男性社員が勤務先の大手損害保険会社を訴えた裁判で、東京地裁（松下絵美裁判官）は8日、男性側の主張を認めて処分を無効とする判決を言い渡した。

A male employee sued his large insurance company employer, arguing that it was unfair to discipline him with a penalty for not stopping inappropriate comments made by another attendee at a company social gathering. In the lawsuit, the Tokyo District Court (Judge Emie Matsushita) ruled on August 8th in favor of the employee, acknowledging his claims and declaring the disciplinary action invalid.

▶判決によると、男性は終業後に複数の社員で行った飲み会で、別の男性社員が女性社員にセクハラ発言を繰り返したのに制止しなかったとして、2024年5月に譴責（けんせき）処分を受けた。

According to the court's ruling, the man was disciplined in May 2024 because, after work, he attended a gathering with other employees where another male employee repeatedly made sexually harassing remarks to a female employee, and he failed to stop it.
